Privacy Policy — Destined for Distinction

This Privacy Policy explains how Destined for Distinction (“we,” “us,” “our”) collects, uses, discloses, and safeguards personal information when you visit destinedfordistinction.com (the “Website”) or use our online services, including our internal booking portal (the “Services”). Psychotherapy and coaching services made available through the Services may be provided by therapists and coaches, including independently contracted practitioners.
This Privacy Policy is intended to reflect applicable Canadian privacy requirements, including the consent-based approach set out in the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable. Personal Health Information connected with Psychotherapy Services may also be subject to Ontario’s Personal Health Information Protection Act, 2004 (PHIPA), where applicable, and the information practices of the identified health information custodian.
1) Scope
This Privacy Policy applies to personal information collected through:
- the Website and its pages;
- our internal booking portal and any related client account area;
- contact forms, psychotherapy or coaching intake/assessment forms, and service enquiries;
- payments made through the Website or related processes; and
- communications with us (email and other channels you use to contact us).
This Privacy Policy explains Destined for Distinction’s information practices. It does not replace any service-specific consent or privacy document provided by your Therapist, Coach or an identified health information custodian, particularly where professional or clinical record-keeping requirements apply. Those documents will explain who is responsible for the applicable service record, who may access it and how to request access or correction.
2) Definitions
- Personal Information: information about an identifiable individual (e.g., name, contact details, booking details).
- Personal Health Information: identifying information about an individual that is subject to PHIPA, where applicable, including information relating to an individual’s physical or mental condition, the provision of health care, or payment or eligibility for health care.
- Sensitive Information: information that is more sensitive by nature (e.g., information you provide in an intake/assessment form). Depending on the service and circumstances, Sensitive Information may also be Personal Health Information.
- Practitioners: the Therapists or Coaches selected to provide direct Psychotherapy Services or Coaching Services. Practitioners may provide services through independent contractor arrangements with Destined for Distinction.
- Service Providers: third parties that help us operate the Website or administer Services (e.g., hosting, security, analytics, communications and payment processors). Service Providers do not include Practitioners when they are providing direct Psychotherapy Services or Coaching Services.
3) Personal information we collect
A) Information you provide directly
Depending on how you use the Website and Services, we may collect:
- Contact information: name, email address, phone number.
- Booking and service information: appointment requests, scheduling preferences, selected service and Practitioner, availability, and related notes you choose to provide.
- Intake/assessment information: information you submit through Psychotherapy Services or Coaching Services forms. This may include Sensitive Information and, in connection with Psychotherapy Services, Personal Health Information.
- Professional-service records: depending on the service and the applicable arrangements, Destined for Distinction, your Practitioner or the identified health information custodian may create or maintain clinical, coaching, appointment, consent or related service records. Service-specific documents will explain responsibility for those records.
- Account information: username, password (stored in encrypted/hashed form), and account settings.
- Insurance and benefit information: where applicable and authorized by you, information such as date of birth, plan or employer information, relationship to the claimant, coverage or eligibility information, and communications with an insurer or benefit administrator.
- Payments and receipts: payment status, transaction references, payer name/email (as applicable), invoice/receipt details, and amounts paid.
B) Information collected automatically (Website and security logs)
When you access the Website, we may collect:
- Device and browser data (browser type, operating system, device type);
- Usage data (pages viewed, referring pages, interactions);
- Log data (IP address, date/time stamps, error logs) used for security, abuse prevention, and troubleshooting.
C) Cookies and similar technologies
We may use cookies and similar technologies to:
- enable core Website functionality;
- support security features (including fraud/spam prevention);
- remember preferences; and
- measure the performance of public informational and marketing pages, including Wellness Corner content and advertising campaigns (see Section 7).
You can manage cookies using your browser settings. Blocking certain cookies may affect Website functionality.
D) Embedded content and third-party features
Some pages may include embedded content (e.g., videos or social feeds). Embedded content from other websites behaves as if you visited those websites directly and may collect data, use cookies, and track interaction under their own policies.
4) How we use personal information
We use personal information to:
- provide, operate, and improve the Website and Services;
- process bookings through our internal booking portal;
- arrange and administer Psychotherapy Services or Coaching Services with your selected Practitioner;
- permit your selected Practitioner and authorized administrative personnel to access the information reasonably necessary to provide or administer your selected service;
- respond to enquiries and provide support;
- deliver services and related administrative communications;
- communicate with an insurer or benefit administrator where you authorize us to do so;
- process payments and issue receipts;
- maintain appropriate service, appointment, billing and consent records;
- maintain site security, prevent spam/fraud, and troubleshoot;
- understand how visitors find and use public informational and marketing pages, Wellness Corner content and advertising campaigns (analytics); and
- meet legal, regulatory, professional and privacy obligations.
We do not sell personal information.
5) Consent (Canada)
We generally collect, use, and disclose personal information with your knowledge and consent, except where permitted or required by law. Consent relating to Psychotherapy Services, Coaching Services or Personal Health Information may also be addressed in service-specific documents provided before services begin.
You may withdraw consent by contacting us (see Section 13), subject to legal or professional requirements and any collection, use or disclosure already authorized or required by law. Withdrawal of consent may limit our ability or a Practitioner’s ability to provide some Services. Withdrawing consent does not necessarily require deletion of information that must be retained under applicable law or professional standards.
6) Payments (PayPal and Interac)
We use third-party payment methods:
- PayPal (online payment processing); and/or
- Interac e-Transfer (payment transfer method).
What we receive/retain: We may receive and store payment confirmations and administrative payment details such as payer name, payer email, transaction reference/ID, amount, date, and the related invoice/receipt information.
What we do not store: We do not intentionally store full payment card numbers. When PayPal is used, payment card handling is performed by PayPal under its own terms and privacy practices.
7) Analytics and advertising (public informational and marketing pages only)
We use Google Analytics and related Google advertising measurement tools on public informational and marketing pages, including our Home, About, Services, Team and Wellness Corner pages, as well as advertising landing pages.
We use this information to:
- understand how visitors find and use our public Website content;
- understand readership and performance of Wellness Corner articles;
- identify which public pages are helpful to visitors; and
- measure and improve advertising effectiveness, including campaign performance and consultation-request conversions.
Analytics is not intended to operate within client login or account areas, pages used to enter booking or intake information, assessment forms, payment pages, or Practitioner and administrative areas. We do not use analytics to collect the contents of contact, booking, intake, assessment or other forms. Automatic form-interaction tracking is disabled.
We may record a general conversion event, such as confirmation that a consultation request was completed, without collecting the information submitted through the form. We do not intentionally send names, email addresses, phone numbers, form responses, appointment or intake details, or Personal Health Information to analytics or advertising providers.
These tools may use cookies or similar technologies to collect limited information about how visitors use eligible public pages. This may include pages visited, time on page, referral source, campaign information and general device or browser information. We configure available privacy controls to reduce unnecessary data collection and redact likely personal information from URLs.
Your choices: You can control analytics-related cookies through your browser settings and any cookie controls made available on the Website. You may also use privacy controls offered by Google or other applicable platforms. For more information, see the Google Privacy Policy.
8) When we disclose or provide access to personal information
We may disclose personal information or provide access to it in the following situations:
A) Practitioners and authorized personnel
Your information may be accessed by or provided to your selected Therapist or Coach and authorized administrative personnel to arrange, administer and provide your selected service. Access is limited to information reasonably necessary for the person’s role. A Practitioner’s independent contractor status does not remove their privacy, confidentiality, legal or professional responsibilities.
For Psychotherapy Services, the applicable service-specific documents will identify the health information custodian and explain who may access the clinical record. Where a Practitioner or other person handles Personal Health Information as an agent of a health information custodian, that handling is governed by PHIPA and the custodian’s information practices.
B) Insurers and benefit administrators
Where you authorize us to do so, we may communicate with an insurer, employer-sponsored benefit plan administrator or other third-party payor to determine eligibility, administer benefits, support direct billing or address a claim. We disclose only the information reasonably required for the authorized purpose, unless additional disclosure is permitted or required by law.
C) Service providers (processors)
We may share personal information with Service Providers that help us operate the Website and administer Services, such as:
- website hosting and infrastructure providers;
- booking, account and administrative technology providers;
- security, performance, and spam-prevention services;
- payment processors;
- email delivery and communications tools (for service/admin messaging); and
- analytics and advertising measurement providers, limited to the public informational and marketing uses described in Section 7.
Service Providers are given access only to the information needed to perform their functions and are expected to protect it.
D) Legal and safety requirements
We may disclose personal information where required to comply with applicable law, lawful requests, court orders, or to protect rights, safety, and security (including investigating fraud or abuse).
E) Business transactions
If we are involved in a merger, acquisition, restructuring, or sale of assets, personal information may be transferred as part of that transaction, subject to applicable law and appropriate safeguards. Any transfer of Personal Health Information will also be subject to PHIPA and the requirements of the identified health information custodian, where applicable.
9) Cross-border processing
We operate from Canada. Some Service Providers may process or store information outside Canada (including in the United States). When information is processed outside Canada, it may be subject to the laws of the jurisdiction where it is stored or processed.
10) Safeguards and security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorised access, disclosure, copying, use, or modification.
Practitioners, authorized personnel and Service Providers are expected to access and handle personal information only as permitted for their roles and to protect it in accordance with applicable confidentiality, contractual, professional and legal requirements.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11) Retention (including account deletion)
We retain personal information only as long as necessary for the purposes described in this Privacy Policy, and as required to meet legal, regulatory, professional, accounting and security obligations.
Psychotherapy records: The identified health information custodian retains Psychotherapy Services records in accordance with applicable law and the standards governing the Therapist. Where an Ontario Registered Psychotherapist is the custodian of a clinical record, the record is retained for at least 10 years from the date of the last interaction with the client, or for 10 years from the client’s 18th birthday, whichever is later. Different requirements may apply to other regulated professionals.
Coaching and administrative records: Coaching records and general administrative records are retained only as long as reasonably necessary for the applicable service and for legal, contractual, accounting, dispute-resolution and security purposes. They are not automatically subject to the CRPO clinical-record retention period solely because Coaching Services were arranged through the Website. Appointment, billing or other records connected with Psychotherapy Services may remain subject to applicable professional retention requirements.
Account closure/deletion requests: If you request that we close or delete your account (where accounts exist), we will deactivate access and delete information that is not required to be retained.
Records retained after account deletion: Closing or deleting an account does not delete records that Destined for Distinction, a Practitioner or an identified health information custodian must retain under applicable law, professional standards or a service-specific agreement.
We may also retain limited security logs and audit information to protect the integrity of our systems and prevent misuse.
12) Children under 13
The Website and Services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 through the Website. If you are under 13, do not submit personal information through the Website.
If you are a parent or legal guardian and believe a child under 13 has provided personal information to us, contact us and we will take reasonable steps to delete the information, except where retention is permitted or required by law.
13) Access, correction, and privacy requests
You may request access to, or correction of, the personal information we hold about you, subject to applicable legal limitations.
To make a request, contact us using the information below. We may need to verify your identity before fulfilling a request. A request relating to a psychotherapy clinical record may be directed to the identified health information custodian or handled in accordance with that custodian’s information practices. Service-specific documents will identify the appropriate contact where it is someone other than Destined for Distinction.
14) Changes to this Privacy Policy
We may update this Privacy Policy from time to time. Updates will be posted on this page with a revised “Last updated” date and will apply from that date. Where applicable law requires additional notice or consent for a change in how information is handled, we will provide that notice or seek that consent.
